Court rules that Lower Saxony’s Toto-Lotto Niedersachsen broke State Treaty on Gambling rules.

In Germany, the state lottery for Lower Saxony, Toto-Lotto Niedersachsen GmbH, has been ordered by the Higher Regional Court of Oldenburg to cease advertising itself online.
Last year, all 16 states in Germany approved the State Treaty on Gambling, which prohibited online gambling including bingo, poker and lottery throughout the country. The Treaty came into effect on the first day of 2008 and included bans on advertising such sites over the Internet, telephone or on television.
The advertisement in questions appeared on the firm’s website and depicted a swimming pool and palm trees with a caption reading ‘as part of your holiday preparations, don’t forget to pay the Lotto before you leave’.
The Court ruled late last week that the advertisement encouraged gambling, thus breaking Paragraph Five of the Treaty, and Toto-Lotto Niedersachsen has been advised that it will not be allowed to appeal.
