Attheraces wins injunctionagainst BHB
Attheraces has won a temporary injunction in the High Court
Monday 18th July 2005
Attheraces has won a temporary injunction in the High Court preventing the British Horseracing Board (BHB) from terminating the supply of data to the company. The injunction also prevents the BHB forcing Attheraces to pay fees or enter into data agreements.
The Vice Chancellor rejected the BHB's arguments that the Court should follow the reasoning in BHB Enterprises plc v Victor Chandler (International) Ltd [2005] EWHC 1074 (Ch) ('VCI') in which Laddie J struck out Victor Chandler's application for an injunction.
Attheraces will continue to make payments into an escrow account. The vice Chancellor directed that the case go to trial on 17 October.
The full judgement can be found here.
There will be a special briefing held to examine the full implications of the appeal court's judgement in BHB vs William Hill onn September the 20 in London.
