US DOJ files motion to dismiss Casino City’s legal challenge

It has emerged that, last week, the Department of Justice filed a motion to dismiss CasinoCity.com’s legal challenge to the US stance on advertising gambling. Casino City, which owns a network of gambling websites launched proceeding against the DOJ last August, claiming that the prohibition of gambling advertising was a threat to free speech and in direct opposition of the First Amendment.
According to the Casino City website, the DOJ’s reaction was widely anticipated as the most likely course of events, and the motion to dismiss duly arrived on their doorstep on 27th October.
Casino City stated: “The motion to dismiss argues that if the activities of Casino City are legal then there is no imminent threat of prosecution, and that in this situation the case should be dismissed. It further argues that if the activities are illegal then First Amendment protection of commercial free speech does not apply, and in this situation the case should also be dismissed.”
