Rousso Gets Day In Court
Washington state online gambling case to be heard on May 15 following ruling last week.
Tuesday 15th April 2008
In America, Seattle lawyer and former gubernatorial candidate Lee Rousso has announced that he is to finally have his day in court following a ruling by Judge Mary Roberts.
Rousso filed a lawsuit last year challenging the constitutionality of Washington's online gambling ban but the case has yet to come to court due to the state employing skilful delaying tactics. The Judge issued a ruling late last week on a discovery motion filed by the state and Rousso’s day in court has now been set for May 15 after being postponed from April 25.
The state representative for the Poker Players Alliance lobby group, Rousso is accusing the state of imposing a ban on online gambling to protect its own gambling industry, which he asserts is a violation of the US Constitution's commerce clause that forbids individual states from passing protectionist laws against other states' business.
“Judge Roberts issued her ruling on my discovery dispute with the state and agreed with me about 99 percent, the state about one percent,” said Rousso.
“In layman's terms, it was a rout. There is just one item left to fight over. Otherwise, it looks extremely likely that I will get my day in court. Due to a change in court scheduling, my hearing date has been moved back to May 15. That date appears to be set in stone so Seattle area poker players should mark their calendars.”
